The laws of the Federation of Nouvelle Alexandrie are made up of many levels of codified and uncodified forms of law. The most important of all the laws is the Constitution of the Federation, the Proclamation of Punta Santiago. This Proclamation prescribes the basic foundational principles and structures of the federal government of Nouvelle Alexandrie, prescribing limits and boundaries to federal law. Federal law consists of Acts of the Cortes Federales, agreements or treaties ratified by the Cortes Federales, regulations established by the executive branch, and case law originating from the judiciary. The Codex Iuris is the official compilation and codification of general and permanent federal statutory law.
Federal laws and treaties, so long as they are in accordance with the Proclamation of Punta Santiago, preempt conflicting regional and local laws in the Regions and the overseas territories of Nouvelle Alexandrie. The Proclamation of Punta Santiago uses Ch. 1, Art. 2 to outline the duties of the federal government, which are drafted in what some scholars have called "generously vague" terms to favor the development of a more powerful federal government as the Federation grew into itself.
In local, regional, and federal levels, with the exception of the Region of the Wechua Nation, most law has either derived from Alexandrian and Caputian law.
General overview
Sources of law
In the Constitutional framework of Nouvelle Alexandrie, the power to make, amend, and approve Law is fundamentally vested in the Cortes Federales. There exists two forms of sources of law: primary and delegated. Primary legislation, known as 'Acts of the Cortes Federales', is created and approved by this body, and is meant to provide broad rules and general principles. Both Deputies and Secretaries of the Council of State can produce bills. Delegated legislation, as indicative of the name, is prepared by the Executive agencies, and are known as Departmental or Secretarial Orders. This delegated law is meant to provide enforceable and specified regulations.
Constitutionality
The Proclamation places itself as the fundamental law of the nation. As such, any and all laws are subject to compliance to it. The Constitutional principles in it emplace the powers and duties for assuring this to the High Court.
Levels of law
Federal law
The 'Acts of the Cortes Federales' work on a national level, and equally apply to all parts of the nation, unless an exception has been put in that act. They override any regional and local law where applicable. Departmental Orders, flowing from these Acts, are also considered federal law, and therefore work nationally.
Regional and territory law
Every Regional government has the right to create and approve laws. These work only in their respective regions, and can implement federal law in a manner specific to them. They have to be compliant, however, to both federal law and the Proclamation.
Local law
Municipalities and County Councils have the right to create and approve laws. They work only in their municipality or county, and are subject to both federal and regional law. Within the federal hierarchy of the nation, they are a rare instrument, and most local government work within regional and federal law.
Codex Iuris
The Codex of Laws is the collected civil code of Nouvelle Alexandrie. They regulate much of the civil law in the nation, pertaining to persons, goods, and property. They were written largely by the Federal Constituent Assembly as part of their work to accompany the Proclamation with a clear body of Laws.
