DEFENSE OF THE FEDERATION ACT, 1694

Ordered, by the Cortes Federales of Nouvelle Alexandrie,
to be Printed, 1694 AN.

BE IT ENACTED by the King’s Most Excellent Majesty, by and with the advice and consent of the Cortes Federales, in this present 1st session assembled, and by the authority of the same, as follows:-

PART I
GENERAL PROVISIONS.

1. CITATION.

  1. This Act shall be officially cited as the “Defense of the Federation Act, 1694”.

2. CONSTITUTIONAL AUTHORITY.

  1. Chapter I, Article 2 of the Proclamation of Punta Santiago confers to the federal government the powers over “national private, criminal, and procedural law”.
  2. Chapter I, Article 2 of the Proclamation of Punta Santiago confers to the federal government the powers over “the defense and territorial integrity of the Federation”, as well as “all other subject matters which by their very nature or as a corollary to the subjects listed have to be centralized on the national level.”

3. PRESIDENT AS PRIMARY ARCHITECT OF DEFENSE POLICY.

  1. Through this measure, the Federal Assembly recognizes that the President of the Government as the primary architect of the defense policy for the federation of Nouvelle Alexandrie, and shall be responsible for its conduct and implementation, and shall be accountable to the Federal Assembly in accordance with established constitutional principles.
  2. The Secretary of Defense shall, by order of the President of the Government, take charge of the matters concerning military affairs, and shall direct and supervise the Chairman of the Council of the Joint Chiefs of Staff and the Chief of Staff of each service of the Federal Forces.

4. ORGANIZATION OF THE FEDERAL ARMED FORCES.

  1. The armed forces of Nouvelle Alexandria shall be called the “Federal Forces of Nouvelle Alexandrie”.
  2. The Federal Forces of Nouvelle Alexandrie shall be composed of the:
    1. the Grand Army of the Federation;
    2. the Federal Navy;
    3. the Federal Air Force;
    4. the Federal Guards Service.
  3. There shall be a Marine Corps established in the Federal Navy.
  4. Each of the Federal Forces shall be headed by a Chief of Staff, appointed by H.M. the King on the advice of the Council of State and after the approval of the Federal Assembly.
  5. The headquarters of the Joint Chiefs of Staff shall be established under the Department of Defense in order to direct and supervise the operation units of each service of the Federal Forces and to carry out joint or allied operations.
  6. When necessary for military purposes, joint units and other agencies may be established under the direction and supervision of the Secretary of Defense, as prescribed by law or Royal Decree.

5. MAIN DUTIES OF EACH SERVICE OF THE FEDERAL FORCES.

  1. The main purposes of the Federal Forces of Nouvelle Alexandrie are:
    1. to preserve the King’s Peace;
    2. to maintain the territorial integrity and security of the Federation and all its possessions and occupied areas;
    3. to support the national policies;
    4. to implement the national objectives and ambitions;
    5. to aid the civil power, as provided by law, in the event of a grievous national disaster or calamity;
    6. to overcome any nations responsible for acts of aggression that imperil the peace and security of Nouvelle Alexandrie.
  2. The main duties of the Grand Army of the Federation shall be operations on the ground, and the Grand Army shall be formed and equipped for that purpose and shall provide the education, training, and resources necessary therefore.
  3. The main duties of the Federal Navy shall be operations on the seas, including landing operations, and the main duties of the Marine Corps shall be landing operations, and the Navy and Marine Corps shall be formed and equipped for those purposes and provide the education, training, and resources necessary therefore.
  4. The main duties of the Federal Air Force shall be aviation operations, and the Air Force shall be formed and equipped for that purpose and shall provide education, training, and resources necessary therefore.
  5. The main duties of the Federal Guards Service shall be:
    1. to guard the borders of the Federation (Border Guard);
    2. to provide special protection and security to the Royal Family, Government officials, and other important dignitaries and foreign officials in New Alexandrian soil (Federal Royal Guards);
    3. to provide for the protection and security of the territorial maritime waters of the Federation, as of its internal waterways and bodies of water, and to of the high seas and waters subject to the jurisdiction of Nouvelle Alexandrie; (Federal Coast Guard)
    4. to provide professional services to all the branches of the Federal Forces (Federal Support Corps).
  6. Additional duties and responsibilities for the armed forces may be provided for by Act of the Cortes Federales.

6. PERSONAL STATUS, ETC. OF SOLDIERS.

  1. “A soldier" means a person who serves the Federal Forces in time of war as well as in time of peace.
  2. Matters concerning personnel affairs, rendition of military services, and personal status of soldiers shall be separately stipulated by other Acts.

7. MILITARY FLAG.

  1. The Federal Forces of Nouvelle Alexandrie shall use military flags.
  2. The types and sizes of military flags and other necessary matters therefore shall be stipulated by Royal Decree.

8. GENERAL AND FLAG OFFICERS.

  1. No officer of general or flag rank in the Federal Forces of Nouvelle Alexandrie shall assume appointment in such rank without the consent of the Federal Assembly, expressed through means of a resolution.


PART II
DEPARTMENT OF DEFENSE.

9. DUTIES OF THE DEPARTMENT OF DEFENSE.

  1. The Department of Defense shall be responsible for:
    1. the coordination of defense and security of all the Federation;
    2. the preservation of the national sovereignty, protection of the Royal Family, government officials, foreign diplomats, and important foreign officials;
    3. the formulation of general defense policy related to all matters of direct and primary concern to the Department of Defense;
    4. the exercise of authority, direction and control over the Federal Forces; and
    5. the execution of defense policy approved by the Council of State.
  2. The Department of Defense shall be led by the Secretary of Defense, who shall be assisted by the Chairman of the Joint Chiefs of Staff, the Director of Military Intelligence, and such Secretaries of State as the Secretary of Defense may establish by Departmental Order or shall by law.
  3. The Secretary of Defense shall have the following powers pertaining to the maintenance of the Imperial Federal Forces, exercisable by Departmental Order:
    1. the setting of the Federal Forces budget;
    2. the maintenance and creation of Orders of Battle;
    3. the deployment of forces within the Federation;
    4. the rank structure of the Federal Forces; and
    5. the promotion and recruitment of officers below the military grade of OF-10.

10. THE JOINT CHIEFS OF STAFF.

  1. The Joint Chiefs of Staff shall be established at the Headquarters of the Joint Chiefs of Staff to assist the Secretary of Defense with regard to military commands, and to deliberate on important military matters and other matters stipulated by statutes.
  2. The Joint Chiefs of Staff shall consist of the Chairman of the Joint Chiefs of Staff and the Chiefs of Staff of each service of the Federal Forces, and the Chairman of the the Joint Chiefs of Staff shall be the chairman thereof provided that when the Joint Chiefs deliberate on any matter concerning the Marine Corps, the commander of the Marine Corps shall also be a member of the Joint Chiefs of Staff.
  3. When the Joint Chiefs of Staff deliberates on any matter concerning a particular operation unit, the Council may require the relevant operation commander to attend the meeting.
  4. The Joint Chiefs of Staff shall hold regular meetings, at least once a month, and matters necessary for managing the Joint Chiefs of Staff shall be prescribed by the Secretary of Defense.
  5. The Chairman of the Council of the Joint Chiefs of Staff shall assist the Secretary of Defense with regard to military commands, and shall direct and supervise, by order of the Secretary of Defense, the operation units of each service of the Federal Forces, the main duty of which is combatting, and shall direct and supervise the joint units established for the purpose of carrying out joint operations provided that in time of peace, prior approval of the Secretary of Defense on the military matters of importance, such as the movement of unit at the independent combat brigade level or higher, shall be obtained.
  6. The scope of the operation units and the joint units of each service of the Federal Forces, the main duty of which is combatting, and the scope of the power of direction and supervision shall be prescribed by law or Royal Decree.
  7. H.M. the King may, by notice and on the advice of the President of the Government in writing, remove a person from office in the Joint Chiefs of Staff if satisfied that:
  8. The person at fault has without reasonable excuse failed, for a continuous period of three months, to carry out their functions;
    1. Absences without reasonable from three consecutive meetings of the Joint Chiefs of Staff;
    2. Conviction (whether before or after appointment) of a criminal offense;
    3. They are otherwise unable or unfit to carry out functions as a member of the Joint Chiefs of Staff.

11. THE SPECIAL DEFENSE COMMITTEE.

  1. There shall be a Committee established in the Council of State that shall be called the Federal Defense Committee, which shall consider the wider political, diplomatic, economic and social issues of the Federation’s defense and security.
  2. The Federal Defense Committee shall be chaired by H.M. the King, and shall be composed of the President of the Government, the Secretary of Defense, the Secretary of State, and the Secretary of Research and Development, and the Chairman of the Joint Chiefs of Staff.
  3. Special Counselors to the Federal Defense Committee may be appointed by H.M. the King, on advice of the Council of State, to the Federal Defense Committee.
  4. The Special Defense Committee, by a vote of a majority of its members, shall have the power to exercise H.M. the King’s authority, with the approval of the Council of State, to deploy the Federal Forces of Nouvelle Alexandrie outside the borders of the Federation, in peace or in war, for a specified period of time no longer than two (2) AN years, without a formal declaration of war.
  5. Further regulation and requirements for the deployment of the Federal Forces of Nouvelle Alexandrie, in time of war or peace, may be prescribed by other Acts.


PART III
ARMY, NAVY, AIR FORCE, AND FEDERAL GUARDS SERVICE.

12. ESTABLISHMENT OF HEADQUARTERS OF EACH SERVICE OF THE FEDERAL FORCES.

  1. The Army Headquarters for the Army, the Naval Headquarters for the Navy, the Air Force Headquarters for the Air Force, and the Headquarters of the Marine Corps for the Marine Corps Command, and the Headquarters of the Federal Guards Services shall be established, respectively.
  2. One Deputy Chief of Staff and necessary branches of staff shall be established at the headquarters of each service of the Federal Forces in addition to its Chief of Staff, and one vice commander of the Marine Corps and necessary branches of staff shall be established at the Marine Corps Command in addition to the commander of the Marine Corps.
  3. The Deputy Chief of Staff of each service of the Federal Forces shall assist the Chief of Staff of the pertinent service of the Federal Forces, and the vice commander of the Marine Corps shall assist the commander of the Marine Corps; and if the Chief of Staff of the pertinent service of the Federal Forces or the commander of the Marine Corps is unable to perform his or her duties due to any unavoidable reason, the Deputy Chief of Staff or the vice commander of the Marine Corps shall act on his or her behalf.
  4. The organization of the Headquarters of each service of the Federal Forces and of the Command of the Marine Corps, and other necessary matters shall be prescribed by Royal Decree, Departmental Order, or by law.

13. CIVILIAN EMPLOYEES OF THE FEDERAL FORCES.

  1. Civilian employees shall be hired in the Federal Forces of Nouvelle Alexandrie, in addition to soldiers.
  2. Matters concerning qualifications, appointment and dismissal, rendition of services, and matters concerning personal status of civilian employees in the Federal Forces of Nouvelle Alexandrie shall be separately prescribed by Acts.


PART IV
OTHER PROVISIONS.

14. WITHHOLDING PUBLIC ANNOUNCEMENT.

  1. Orders to be enacted under this Act may not be announced publicly when it is deemed necessary for the purpose of keeping military secrets.

15. COMMENCEMENT AND APPLICATION.

  1. This Bill shall apply to all of the Federation of Nouvelle Alexandrie.
  2. This Bill shall not become law unless it has been given Royal Assent.
  3. In the event any provision or part of this Bill is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Bill, will be inoperative.
