Treaty between Hurmu and New Batavia

The Treaty of friendship and non-aggression between Hurmu and the Islamic Republic of New Batavia is a treaty between Hurmu and New Batavia. It was signed on 22.II.1691.

The signing ceremony occurred in the Palace of the Elenaran, in Vesüha. Representing Hurmu were Senators Jan Spiik and Ellen Aarevalla, the primary diplomats of the Senate. Frans represented the president of New Batavia, Saladin. Guests in attendance included Prime Minister Daniyal al-Osman, the Hurmu cabinet and all members of the Senate, as well as guests from the diplomatic corps and representatives of businesses and civil society.

Treaty of friendship and non-aggression between Hurmu and the Islamic Republic of New Batavia

The Senate of the Lakes,
The President of the Islamic Republic of New Batavia,

having come into contact with one another, and finding their interests to be coincident, do desire to formalize and secure their cordial feelings, they have appointed as their plenipotentiaries, for the Senate of the Lakes, Mr Jan u-Samil Spiik and Ms Ellen Aarevalla, Senators, and for the President of the Islamic Republic of New Batavia, Frans, who, having exchanged their accreditations and finding them to be in good form, have agreed as follows:

Article 1. Hurmu and the Islamic Republic of New Batavia recognize the other's sovereignty and right to self-rule of its state, its peoples, and its government institutions.

Article 2. Hurmu and the Islamic Republic of New Batavia recognize one another as the rightful owner of all territory that they claim on the MCS map with the consent of the Council of the MCS.

Article 3. Hurmu and the Islamic Republic of New Batavia commit to resolve all mutual disputes peacefully, using a neutral third party agreed to by both should this prove impossible by normal channels.

Article 4. Hurmu and the Islamic Republic of New Batavia shall remain open and accessible to tourists and other visitors from one another, barring national emergencies or other such security issues.

Article 5. Hurmu and the Islamic Republic of New Batavia shall have proper and open channels of communication so to facilitate dialogue and future cooperation.

Article 6. Hurmu and the Islamic Republic of New Batavia shall not engage in or sponsor any covert or overt military activity against the peoples or government institutions of the other.

Article 7. This treaty may only be amended, revised, enlarged and expanded upon the concurrence of both signatory parties. Any contrary action or measure shall be null and void.

Article 8. This treaty shall enter into force upon ratification of both signatories in accordance with their native constitutional procedures.

Article 9. The signatory parties may repeal this treaty on the condition of a notice of one year according to the calendar of Emperor Norton.

In witness whereof, the aforementioned plenipotentiaries have signed their names and affixed their seals.

Ratification

Immediately after the signing ceremony, the Senate of the Lakes met and approved the ratification of the treaty with acclamation.

The New Batavian government expected ratification to take longer time due to the bureaucratic constraints of its own government. On 8.VI.1691, the New Batavian Majlis-ash-Shoera adopted the treaty, only for it to be vetoed by the President. The President explained the veto by saying that he believed that ratification of the Treaty would be unconstitutional because it was not written in the language of the Republic. Under the New Batavian constitution, the Supreme Court will now examine the question of constitutionality of the ratification of the treaty with Hurmu, and if the Supreme Court finds that the treaty is constitutional, the President will be obliged to sign into law.

The New Batavian government kept the Hurmu government updated about the situation.

A spokesman for the Senate said: "We respect the legal processes of New Batavia. New Batavia is a true friend to Hurmu, and Hurmu wishes to reciprocate that sentiment. We await the conclusion from the Supreme Court. We understand that this is a matter of legal nature, and does not at all reflect upon the friendship between Hurmu and New Batavia. Regardless of the outcome in the Supreme Court, New Batavia and Hurmu will remain close and friends. The only thing is that the formal nature of a treaty may take a little longer, that's all."

The Supreme Court of New Batavia ruled on December 13, 2020 that the proposed law to ratify the treaty was illegal as it had not been translated to the language of the Republic. The Government of New Batavia then resubmitted an authorized translation of the treaty to the language of the Republic, and the Majlis-ash-Shoera subsequently reratified it, and it was signed into law by the President.
