Special-053-001
Special-053-001, formally the Nouvelle Alexandrie Friendship and Non-Aggression Treaty Vote, was a special treaty vote held during the 53–54 PSSC legislative cycle of the Bassaridian Legislature. Convened on 25/3/53 PSSC by invitation of the Council of Kings, the vote invited the Council of Representatives and the Senate of Elders to debate and vote on the Treaty between Nouvelle Alexandrie and Bassaridia Vaeringheim despite ordinary legislative approval not being constitutionally required for the treaty's Bassaridian acceptance.
The special vote passed the Council of Representatives on 26/3/53 PSSC and passed the Senate of Elders on 28/3/53 PSSC. The Council of Kings approved and received the legislative expression of assent on 28/3/53 PSSC. Its passage gave the treaty a public legislative endorsement in recognition of its importance for non-aggression, lawful passage, Keltian consultation, and the protection of Bassaridian Straits, General Port, Strait of Haifa, Haifa Compliance Exchange, White-Lane, and Southern Strait frameworks.
Background
The Treaty between Nouvelle Alexandrie and Bassaridia Vaeringheim was concluded as a friendship and non-aggression agreement between Nouvelle Alexandrie and Bassaridia Vaeringheim. It emerged from a period in which humanitarian cooperation, Keltian stability, lawful passage, and de-escalation had become recurring concerns in Bassaridian foreign policy.
Under the ordinary constitutional order of Bassaridia Vaeringheim, the Council of Kings held the relevant authority to approve the treaty on behalf of the state. The treaty was signed at Lewisburg on 13.X.1758 AN, corresponding to 25/3/53 PSSC, by Merchant General Basilios Barakat al-Moravi acting under the unanimous authority of the Council of Kings. Legislative approval by the Council of Representatives and the Senate of Elders was therefore not strictly required as a condition of Bassaridian acceptance.
Nevertheless, the Council of Kings invited the legislature to debate and vote on the treaty because of its political significance. The agreement concerned not only formal friendship and non-aggression with Nouvelle Alexandrie, but also lawful commercial and humanitarian passage, consultation on Keltian stability, and the protection of Bassaridia's existing maritime, port, straits, corridor, and administrative frameworks.
The treaty's non-derogation provisions were especially important to Bassaridian lawmakers. These provisions preserved the domestic law, constitutional order, and internal frameworks of both parties. For Bassaridia Vaeringheim, the protected frameworks included the Straits Conventions of 52.06 PSSC, the General Port of Lake Morovia, the Strait of Haifa regime, the Haifa Compliance Exchange, White-Lane humanitarian and essential-goods corridors, and the Southern Strait corridor posture.
Special-053-001 was therefore not an ordinary bill or resolution in the usual domestic legislative sense. It was a special treaty vote: a public expression of legislative assent requested by the Council of Kings in order to demonstrate that the treaty possessed support beyond the executive and diplomatic authorities that had negotiated and approved it.
Provisions
The Nouvelle Alexandrie Friendship and Non-Aggression Treaty Vote provided for:
- the formal debate of the Treaty between Nouvelle Alexandrie and Bassaridia Vaeringheim by the Council of Representatives and the Senate of Elders;
- the recognition that legislative approval was not constitutionally required for the treaty's Bassaridian acceptance, but was invited by the Council of Kings because of the treaty's political and diplomatic importance;
- the endorsement of friendship, mutual recognition, non-aggression, peaceful settlement of disputes, and lawful commercial and humanitarian passage between Bassaridia Vaeringheim and Nouvelle Alexandrie;
- the recognition of the treaty's consultative provisions concerning regional peace, lawful passage, civilian movement, commerce, and stability in Keltia;
- the affirmation that the treaty did not create an alliance, joint command structure, enforcement right, inspection right, or operational authority for either party within the jurisdiction of the other;
- the protection of Bassaridia's existing constitutional, maritime, port, straits, corridor, security, and administrative arrangements;
- the express legislative recognition of the continued status of the Straits Conventions, General Port, Strait of Haifa regime, Haifa Compliance Exchange, White-Lane corridors, and Southern Strait corridor posture;
- the recording of the Council and Senate votes as a public expression of legislative confidence in the treaty;
- the return of the legislative vote to the Council of Kings for approval, notation, and entry into the record.
The special vote did not amend the treaty, create additional obligations beyond the treaty text, or transfer treaty-making authority from the Council of Kings to the legislature. Its purpose was to provide an extraordinary public legislative endorsement of a treaty already accepted through the competent Bassaridian authority.
Text of the special vote
The text of the Nouvelle Alexandrie Friendship and Non-Aggression Treaty Vote was as follows:
Nouvelle Alexandrie Friendship and Non-Aggression Treaty Vote
Special-053-001A special treaty vote invited by the Council of Kings to permit the Council of Representatives and the Senate of Elders to debate and vote upon the Treaty between Nouvelle Alexandrie and Bassaridia Vaeringheim, notwithstanding that ordinary legislative approval is not constitutionally required, in recognition of the treaty's significance for non-aggression, lawful passage, Keltian consultation, and the protection of Bassaridian internal frameworks.
Whereas the Treaty between Nouvelle Alexandrie and Bassaridia Vaeringheim establishes a framework of friendship, mutual recognition, non-aggression, lawful commercial and humanitarian passage, consultation, and practical cooperation between Nouvelle Alexandrie and Bassaridia Vaeringheim;
Whereas the treaty was signed at Lewisburg on 13.X.1758 AN, corresponding to 25/3/53 PSSC, by Merchant General Basilios Barakat al-Moravi acting under the unanimous authority of the Council of Kings;
Whereas the Council of Kings possesses the competent authority to approve the treaty for Bassaridia Vaeringheim under the ordinary constitutional practice of the state;
Whereas legislative approval by the Council of Representatives and the Senate of Elders is not constitutionally required as a condition of Bassaridian acceptance of the treaty;
Whereas the Council of Kings has nevertheless invited both houses of the Bassaridian Legislature to debate and vote upon the treaty because of its importance to foreign policy, Keltian stability, lawful passage, public confidence, and the protection of Bassaridian institutional frameworks;
Whereas the treaty provides for mutual non-aggression and requires each party to refrain from supporting armed attacks, sabotage, terrorism, unlawful blockade, proxy violence, or irregular armed action against the other;
Whereas the treaty supports lawful commercial and humanitarian passage through waters, ports, roads, corridors, and other routes under the jurisdiction of either party, while preserving published and non-discriminatory rules concerning safety, customs, security, environmental protection, public order, inspection, routing, closure, emergency measures, and treaty obligations;
Whereas the treaty preserves the constitutional order, domestic law, existing treaty obligations, lawful administrative arrangements, and internal frameworks of both parties;
Whereas for Bassaridia Vaeringheim, the internal frameworks protected by the treaty include the Straits Conventions of 52.06 PSSC, the General Port of Lake Morovia, the Strait of Haifa regime, the Haifa Compliance Exchange, White-Lane humanitarian and essential-goods corridors, and the Southern Strait corridor posture;
Whereas the treaty does not create an alliance, joint command structure, operational right, inspection authority, checkpoint authority, enforcement power, or military presence for either party within the jurisdiction of the other;
Whereas the treaty's consultation provisions provide a peaceful channel for communication on bilateral relations, regional peace, lawful passage, civilian movement, commerce, and stability in Keltia without creating a veto or supervisory authority over either party's sovereign policy;
Whereas the Council of Representatives and the Senate of Elders may, by special vote, record their support for the treaty without altering the constitutional distribution of treaty-making authority;
Now therefore be it voted by the Council of Representatives, subject to review by the Senate of Elders and approval or notation by the Council of Kings, as follows:
1. Recognition of treaty. The Council of Representatives recognises the Treaty between Nouvelle Alexandrie and Bassaridia Vaeringheim as a significant bilateral treaty of friendship and non-aggression.
2. Special character of vote. This vote is a special treaty vote invited by the Council of Kings. It is not an ordinary bill and shall not be read as requiring legislative approval for every treaty concluded by the competent Bassaridian authority.
3. Legislative debate. The treaty shall be placed before the Council of Representatives and the Senate of Elders for debate concerning its diplomatic, commercial, humanitarian, security, constitutional, and regional implications.
4. Non-aggression endorsed. The Council endorses the treaty's provisions for mutual non-aggression, peaceful settlement of disputes, and refusal to support armed attacks, sabotage, terrorism, unlawful blockade, proxy violence, or irregular armed action against either party.
5. Lawful passage endorsed. The Council endorses the treaty's support for lawful commercial and humanitarian passage, subject to the lawful, published, and non-discriminatory rules of the party having jurisdiction over the relevant route, port, road, corridor, or waterway.
6. Keltian consultation recognised. The Council recognises the treaty's standing line of contact for consultation on bilateral relations, regional peace, lawful passage, civilian movement, commerce, and stability in Keltia.
7. No alliance created. The Council records that the treaty does not create a military alliance, joint command, combined patrol authority, enforcement right, inspection right, or operational permission for either party within the jurisdiction of the other.
8. Non-derogation affirmed. The Council affirms that nothing in the treaty overrides, weakens, or derogates from the constitution, domestic law, existing treaty obligations, lawful administrative arrangements, or internal frameworks of Bassaridia Vaeringheim.
9. Bassaridian frameworks protected. The Council expressly recognises the continued protection of the Straits Conventions of 52.06 PSSC, the General Port of Lake Morovia, the Strait of Haifa regime, the Haifa Compliance Exchange, White-Lane humanitarian and essential-goods corridors, and the Southern Strait corridor posture.
10. No external enforcement authority. The Council records that references to Bassaridian internal frameworks do not make Nouvelle Alexandrie a party to, guarantor of, supervisor of, or enforcing authority for those frameworks except where separately accepted under another agreement.
11. Domestic authority preserved. The Council records that Bassaridia Vaeringheim retains its constitutional, maritime, port, straits, corridor, security, and administrative arrangements within the scope of its lawful jurisdiction.
12. Practical cooperation noted. The Council recognises that future practical cooperation in trade, education, cultural contact, scientific cooperation, humanitarian coordination, and de-escalation may proceed only according to the treaty and any separately negotiated written agreements required for operational matters.
13. No operational presumption. No operational, military, security, liaison, corridor, port, checkpoint, patrol, inspection, enforcement, or command arrangement shall be presumed from this special vote.
14. Legislative assent. The Council of Representatives records its assent to the treaty as a matter of public confidence, legislative consultation, and national political endorsement.
15. Transmission to the Senate of Elders. Upon passage by the Council of Representatives, this special treaty vote shall be transmitted to the Senate of Elders for debate and vote.
16. Senate review. The Senate of Elders is invited to consider the treaty's diplomatic, religious, economic, military, commercial, constitutional, and institutional implications.
17. Return to the Council of Kings. Following Senate action, the vote shall be returned to the Council of Kings for approval, notation, or other entry into the record as the Council of Kings considers appropriate.
18. No amendment of treaty. Nothing in this special vote shall amend the text of the treaty or create obligations beyond those accepted by the parties under the treaty itself.
19. Effect. Upon passage by both houses and approval or notation by the Council of Kings, this special vote shall stand as the recorded legislative endorsement of the Treaty between Nouvelle Alexandrie and Bassaridia Vaeringheim during the 53–54 PSSC legislative cycle.
20. Entry into record. This special vote shall enter the legislative record upon approval or notation by the Council of Kings.
Legislative history
Special-053-001 was convened on 25/3/53 PSSC by invitation of the Council of Kings. The invitation followed the signing of the Treaty between Nouvelle Alexandrie and Bassaridia Vaeringheim at Lewisburg on the same date by Merchant General Basilios Barakat al-Moravi, acting under the unanimous authority of the Council of Kings.
The vote was unusual because ordinary legislative approval was not required for the treaty's Bassaridian acceptance. The Council of Kings nevertheless placed the treaty before the Council of Representatives and the Senate of Elders to allow public debate and to secure a recorded expression of legislative confidence. The decision reflected the treaty's significance for non-aggression, lawful passage, Keltian consultation, and the protection of existing Bassaridian frameworks.
The Council of Representatives passed the special treaty vote on 26/3/53 PSSC. Its passage through the elected chamber demonstrated that the treaty enjoyed support beyond the Council of Kings and the diplomatic authorities that had concluded it. The vote was then transmitted to the Senate of Elders, which passed it on 28/3/53 PSSC after considering its diplomatic, religious, economic, military, commercial, constitutional, and institutional implications.
The Council of Kings approved and received the legislative expression of assent on 28/3/53 PSSC. This completed the special voting process and entered the legislature's endorsement of the treaty into the record of the 53–54 PSSC cycle.
Effect
The passage of Special-053-001 did not create the treaty, amend its text, or establish a new constitutional requirement for legislative approval of future treaties. Its legal effect was therefore narrower than that of an ordinary bill. It served as a special legislative endorsement of a treaty already accepted through the competent Bassaridian authority.
Its political effect was more significant. By approving the special vote, the Council of Representatives and Senate of Elders publicly endorsed friendship and non-aggression with Nouvelle Alexandrie, recognised the value of lawful commercial and humanitarian passage, and supported the creation of a consultative framework for matters affecting Keltian peace, civilian movement, commerce, and regional stability.
The vote also clarified the legislature's understanding of the treaty's limits. It recorded that the treaty did not create an alliance, joint command, inspection right, patrol authority, enforcement power, or operational presence for either party within the jurisdiction of the other. Future operational, security, port, corridor, checkpoint, patrol, inspection, enforcement, or command arrangements would require separate written agreements.
For Bassaridia Vaeringheim, the most important effect of the vote was its affirmation of non-derogation. The legislature expressly recognised that the treaty preserved Bassaridia's constitutional order, domestic law, existing treaty obligations, and internal frameworks. This included the Straits Conventions of 52.06 PSSC, the General Port of Lake Morovia, the Strait of Haifa regime, the Haifa Compliance Exchange, White-Lane humanitarian and essential-goods corridors, and the Southern Strait corridor posture.
Special-053-001 therefore functioned as a diplomatic-confidence vote. It allowed the legislature to support a major treaty without weakening the authority of the Council of Kings or confusing the status of Bassaridia's internal corridor and straits systems. Its approval demonstrated that the early 53–54 PSSC legislature was willing to endorse foreign-policy de-escalation where such de-escalation preserved Bassaridian sovereignty, lawful passage, and the integrity of existing national frameworks.
