BE IT ENACTED by the King’s Most Excellent Majesty, by and with the advice and consent of the Cortes Federales, in this present session assembled, and by the authority of the same, as follows:-
Article 1: Title
- This Act may be cited as the "Federal Military Deployment and Oversight Act, 1730."
Article 2: Definitions
- For the purposes of this Act:
- "Military Deployment" refers to any movement of the Federal Forces of Nouvelle Alexandrie beyond national borders or within the nation for the purpose of conducting military operations or exercises.
- "Executive Branch" refers to the President of the Government of Nouvelle Alexandrie, the Council of State of Nouvelle Alexandrie and their appointed officials.
Article 3: Deployment Authorization
- The deployment of the Federal Forces of Nouvelle Alexandrie for combat operations must receive prior approval from the Cortes Federales, except in cases where:
- Immediate action is required to defend Nouvelle Alexandrie or its allies against an imminent attack. This includes scenarios where delay in deployment could result in significant harm to national security or to the defense of allied nations under mutual defense agreements.
- The deployment is part of a multinational operation under an existing treaty ratified by the Cortes Federales. This includes commitments under the Raspur Pact or any other international defense alliance to which Nouvelle Alexandrie is a signatory.
- Engagements in peacekeeping, humanitarian missions, or other non-combat operations approved by international bodies where Nouvelle Alexandrie is a member, do not require prior approval but must be reported to the Cortes Federales as soon as practically possible.
- In cases where the Executive Branch deploys forces without prior approval due to exigent circumstances, the President of the Government or the Department of Defense is required to notify the Cortes Federales within 48 hours of deployment. The notification must include detailed reasons for the deployment, the geographical scope, expected duration, and any anticipated impacts on Nouvelle Alexandrie's military posture or international relations.
- The President of the Government or the Department of Defense must make every effort to inform the public about major deployments in a timely manner, respecting operational security requirements.
Article 4: Legislative Oversight
- The Cortes Federales shall hold regular sessions, at least biannually, to review and evaluate ongoing military deployments. These sessions are intended to assess the alignment of deployments with national security objectives, legislative intent, and international obligations.
- The Executive Branch, through the Department of Defense, is required to submit a comprehensive report to the Cortes Federales every 60 days on the status of deployed forces. The report must include:
- A clear statement of objectives for each deployment, including any updates or changes since the last report.
- Progress towards achieving stated objectives, including milestones reached and challenges encountered.
- An overview of any changes in the scope or scale of operations, including increases or decreases in troop numbers, shifts in geographic focus, or alterations in the rules of engagement.
- An assessment of the impact of deployments on Nouvelle Alexandrie's defense capabilities, readiness, and international relations.
- Detailed accounting of expenditures related to the deployment to ensure fiscal transparency and accountability.
- The Cortes Federales, through its relevant committees, may request additional briefings, reports, or testimonies from the Department of Defense or other executive agencies to ensure thorough oversight. The Executive Branch is obligated to comply with such requests in a timely and comprehensive manner.
- In the interest of national security, certain details within the reports or briefings may be classified or restricted. However, the Cortes Federales retains the authority to access classified information within secure settings to fulfill its oversight responsibilities.
- Failure by the Executive Branch to adhere to these reporting and transparency requirements shall be grounds for legislative inquiry and possible action, including but not limited to, censure, the calling for a vote of no confidence, or the initiation of impeachment proceedings against responsible officials.
Article 5: Withdrawal Authority
- The Cortes Federales may vote to require the withdrawal of deployed forces if it deems the operation no longer serves Nouvelle Alexandrie's interests or if the initial objectives have been achieved.
- Such a vote shall be binding on the Executive Branch, which must commence withdrawal procedures within 30 days.
Article 6: Exemptions
- This Act does not limit the President's authority to deploy forces for non-combat operations, such as humanitarian aid or disaster response, provided such deployments do not involve engagement in hostilities.
Article 7: Commencement and Application
- This Bill shall apply to all future deployments of the Federal Forces of Nouvelle Alexandrie.
- This Bill shall not become law unless it has been given Royal Assent.
- This Bill shall be published and made publicly available.
- In the event any provision or part of this Bill is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Bill, will be inoperative.
