RODINIA RIVER AUTHORITY ACT, 1727

Presented by Deputy Paolo Antonio Aguilar, FHP, and

Ordered, by the Cortes Federales of Nouvelle Alexandrie,

BE IT ENACTED by the King's Most Excellent Majesty, by and with the advice and consent of the Cortes Federales, in this present 7th session assembled, and by the authority of the same, as follows:-

1. CITATION.

  1. This Act shall be officially cited as the “Rodinia River Authority Act, 1727”.

2. DECLARATION OF POLICY.

  1. It is hereby declared to be the national policy to promote and accelerate the economic development and balanced growth of the Rodinia River area and the surrounding localities, within the context of the national and regional plans and policies for social and economic development and to carry out the development of the Rodinia River region with due regard and adequate provisions for environmental management and control preservation of the quality of human life and ecological systems, and the prevention of undue ecological disturbances, deterioration and pollution.

3. RODINIA RIVER AUTHORITY. For the purpose of carrying out and effecting the declared policy, there is hereby created a Rodinia River Authority. The Authority shall execute the powers and functions herein vested and conferred upon it in such a manner as will, in its judgment, aid to the fullest possible extent in carrying out the aims and purposes set forth below.

4. POWERS, DUTIES, AND RESPONSIBILITIES. The Rodinia River Authority shall:

  1. Make a comprehensive survey of the physical and natural resources and potentialities of the Rodinia River region particularly its social and economic conditions, hydrologic characteristics, power potentials, scenic and tourist spots, regional problems, and on the basis thereof, to draft a comprehensive and detailed plan designed to conserve and utilize optimally the resources within the region, to promote the region's rapid social and economic development. For the purpose of the said survey, public agencies shall submit and private entities shall provide necessary data except such data which under existing laws are deemed inviolable.
  2. Provide the support for extending the necessary planning, management and technical assistance to prospective and existing investors in the region
  3. Review and approve or disapprove all plans, programs, and projects proposed by local government offices, agencies, and authorities within the region, public corporations, and private persons or enterprises where such plans, programs and/or projects are related to those of the Authority for the development of the region as envisioned in this Act. The Authority shall issue the necessary clearance for approved proposed plans, programs, and projects within thirty days from submission thereof unless the proposals are not in consonance with those of the Authority or that those will contribute to the unmanageable pollution of the Rodinia River waters or will bring about the ecological imbalance of the region: Provided, further, That the Authority is hereby empowered to institute necessary legal proceeding against any person who shall commence to implement or continue implementation of any project, plan or program within the region without previous clearance from the Authority.
  4. To act in coordination with existing governmental agencies in establishing water quality standards for industrial, agricultural and municipal waste discharges into the river and to cooperate and coordinate with said existing agencies of the government in enforcing such standards.
  5. Undertake studies on the improvement and maintenance of the desirable water quality of Rodinia river, and in pursuance thereof, prepare a water quality management program on a continuing basis, which the Authority shall carry out with the assistance and support of all national and local government units involved in water quality management.

5. EXEMPTION FROM TAXES. The Authority shall be exempt from all taxes, licenses, fees, and duties, incidental to its operations.

6. OFFICIALS OF THE AUTHORITY.

  1. The Rodinia River Authority shall be governed by the Rodinia River Authority Council, to be composed of the following:
  • Governor of Antisuyu
  • Governor of Chinchaysuyu
  • Governor of Roanne
  • Governor of Qullasuyu
  • Governor of New Caputia
  1. The Secretary of the Interior shall be Senior Vice Chair, with the Secretary of Energy and the Environment as Vice Chair of the Rodinia River Authority Council, both of whom shall have voice and vote in the Council. The Chair of the Rodinia River Authority Council shall be chief executive of the Authority and shall be appointed by the President of the Government of Nouvelle Alexandrie and shall serve for a fixed term of five years.
  2. There shall be an Executive Director of the Authority who shall be the chief operations officer and shall serve co-terminus with the Chair, who shall be appointed by the Chair of the Authority.
  3. The organization and staffing pattern of the Authority shall be as the Chairman shall provide, upon approval of the Council.
  4. For administrative purposes, the Authority shall be under the immediate and direct supervision of the President of the Government of Nouvelle Alexandrie, and the Authority shall be under the Office of the President of the Government of Nouvelle Alexandrie.

7. CHAIRMAN OF THE AUTHORITY. The Chairman shall establish his residence within the region. The Chairman shall not, during their term of office, engage in any business or profession or calling other than those connected in the performance of their official duties as Chairman of the Authority.

8. PROHIBITIONS ON CONFLICT OF INTEREST. No person who is a member of the Council or of the Authority shall be financially interested, directly or indirectly, in any contract entered into by the Authority or in any special privileges granted by the Authority during their term of office. All contracts entered into in violation of this provision shall automatically be null and void. Any member of the Council found violating the provisions of this section, by a two-thirds (2/3) vote of the Council shall automatically be disqualified from serving their unexpired term, and shall furthermore be perpetually disqualified for appointment to the Council or with employment with the Authority.

No person who is related within the fourth degree of consanguinity or affinity to the Chairman or members of the Council shall be employed as a consultant or employee of the Authority.

9. BUDGET. Upon enactment of this Act, an amount of 25 million ecus not otherwise appropriated shall be appropriated and credited to the Rodinia River Authority, provided that no more than 5 million ecus shall be appropriated for administrative and personnel costs. Thereafter, an amount of 25 million ecus not otherwise appropriated shall be appropriated and credited to the Rodinia River Authority every year. Public donations and individual contributions may likewise be solicited and provided, and all such donations of personal property, real property and money shall be free of tax.

10. COMMENCEMENT AND APPLICATION.

  1. This Bill shall apply to all of the Federation of Nouvelle Alexandrie.
  2. This Bill shall not become law unless it has been given Royal Assent.
  3. In the event any provision or part of this Bill is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Bill, will be inoperative.
