Preliminary

Short Title

1. This regulation may be cited as the Commercial Forum Regulation 2013.

Statutes Amended

2. Gotzborg Regulation 001/13 is hereby repealed in its entirety.

Commencement

3. This regulation shall commence upon publication in the Royal Gazette (Government Notices Forum).

Authority

4. The administration of this regulation and the provisions within shall be undertaken by the Office of Estates Registry unless otherwise specified below.

5. The collection of rent and property taxes resulting from commercial forums shall be handled directly by the Directorate of Finance.

6. This regulation applies only to forum space located on the official Gotzborg community forums.

Entities Regulated

7. A business entity as defined and registered in accordance with the Business and Corporation Registration Act shall have the right to obtain commercial forum space in accordance with this regulation and, where such forum space is obtained, it shall be bound by the requirements of this regulation.

Rental of Royal Government-Controlled Forum Space

Limited Rental Space

8. The Royal Government shall have no more than eight (8) parent-level forums available for rental by business entities at any given time. A wait list shall be maintained when necessary, with a first-come-first-serve priority sequence for forum space as it becomes vacant.

9. Each parent-level forum rented by the Royal Government is expandable by a maximum of one (1) sub-level forum.

Renting by Business Entity

10. Where a business entity wishes to rent forum space from the Royal Government, it shall make an application to the Office of Estates Registry, in accordance with a procedure ascribed by the Vice-Minister of Public Works or his designate.

11. The business entity agrees to pay rent at the agreed rental fee indicated below for a cumulative period of six (6) months, which shall be known as the lease period.

Rental Fee

12. The required rental fee shall be remitted by the business entity to the account of the Royal Government on the exchange within the first thirty (30) days of the commencement of each lease period.

13. For each six (6) month lease period, a business entity shall remit a payment of 600 Thalers for each parent-level forum rented, and a further 300 Thalers for each sub-level forum rented.

End of Lease / Eviction from Rental Space

14. The Office of Estates Registry shall be permitted to evict a business entity from its rental space where the entity has failed to remit the agreed rental fee in accordance with Articles 12 and 13.

15. A business entity which has its funds seized by the Royal Government in accordance with the Inactivity Tax Act shall forfeit its rental space.

16. Each business entity renting forum space shall advise the Office of the Estates Registry within the last thirty (30) days of its lease period as to whether the lease will be terminated. If notice is not provided, the lease will renew automatically until such a time as the forum space is vacated.

17. Where a business entity is evicted in accordance with the above, the Directorate of Finance may seek damages equivalent to one-month of rent from the entity, totaling 100 Thalers for each parent-level forum and 50 Thalers for each sub-level forum.

Construction of Private Forum Space

Right to Construct on Community Forums

18. A business entity may forego the rental of Royal Government-controlled forum space in accordance with the aforementioned provisions and construct its own forum space on the community forums in accordance with the below requirements.

19. The Office of Estates Registry shall provide the necessary parent-level and sub-level forums to the business entity as constructed in accordance with the below requirements unless where database functionality precludes such.

Process of Constructing Forum Space

20. Where a business entity wishes to construct, or own, its own forum space on the community forums, it shall be required to construct, within the guise of the wider simulation of Gotzborg, an office or office building by contracting an appropriate business to provide such a service.

21. A business entity desiring a parent-level forum, which is representative of a building, shall engage an appropriate contractor to construct its own office building in-simulation before the Office of Estates Registry grants an operational forum.

22. A business entity desiring a sub-level forum, which is representative of an office within an existing building, shall engage an appropriate contractor to outfit its office within the existing building before the Office of Estates Registry grants an operational forum.

23. With respect to Article 9, the Office of Estates Registry shall grant the forum space upon receipt of acceptable proof-of-ownership which shall include, but is not limited to, a copy of a quotation from the constructor, and a copy of receipt of payment to the constructor indicating that the building or office has been constructed in-simulation.

Right to Rent Own Space

24. A business entity that owns a parent-level forum shall be permitted to rent out its own sub-level forums to other business entities, provided that those other entities undertake the necessary work as noted above in Article 22.

Location of Constructed Forum Space

25. The business entity may specify where it desires its forum space to be constructed. That is, in the Furstenmarkt Corporate Offices section, or as a sub-forum of an existing territorial section, for example that of a Royal Colony.

Limitations on Number of Forums

26. In any case, a parent-level forum constructed in accordance with this Part shall not have more than four (4) sub-level forums at a given time.

Property Tax

27. Each business entity holding constructed forum space in accordance with this Part shall remit, in concert with each quarterly tax-assessment period, a property tax to the Directorate of Finance.

28. The property tax shall be remitted in the following amounts: for each parent-level forum, a quarterly remittance of 240 Thalers; for each sub-level forum, a further remittance of 150 Thalers.

29. Property tax shall be remitted within thirty (30) days of the end of the assessment period.

Forfeiture of Forum Space

30. A business entity which has its funds seized by the Royal Government in accordance with the Inactivity Tax Act shall forfeit its forum space.

31. A business entity which fails to remit its property tax for two successive assessment periods shall be liable to forfeit its forum space at the discretion of the Office of Estates Registry.

32. The Directorate of Finance may seek damages equivalent to the outstanding property tax on any privately-held forum space where that space is forfeited.
