Noursala v. Russo, 127 A.L.R. 032 (1735 AN), is a decision by the High Court of Aerla which ruled that the removal of unauthorized encampments on public property is not a violation of the Freedom of Assembly clause of Chapter II, Article IV of the Aerlan Constitution.

The case stemmed from a complaint lodged by the City of Noursala against Peter M. Russo, President of the Noursala Firefighters Union, for organizing an encampment in the lawn of Noursala City Hall in protest of budget cuts as part of the city's annual budget. Russo was arrested after refusing a directive from the Noursala Police Department to clear the encampment, and afterwards was sentenced by the Municipal Court of Noursala to pay a Ƒ750 fine.

Background

In early 1732 AN, the Noursala City Council approved it's annual budget. This specific year's budget had a decrease in funding for new equipment and vehicles for the city's fire department. The President of the Noursala Firefighters Union, Peter M. Russo, organized a demonstration where a group of supporters would encamp themselves in the front lawn of Noursala City Hall to demand that their funding be restored.

The protestors had organized themselves in front of City Hall at roughly 8:00 PM and began to set up camping tents. The Noursala Police Department at first chose to ignore the tents, believing that they would vacate the lawn by midnight. At around midnight, when they did not vacate, Police Captain James Nardin ordered over loudspeakers that the group was not authorized to encamp on the lawn, and gave the group two hours to disperse. At roughly 2:00 AM, citing the group's further refusal to vacate, a police squadron began to clear the encampment and arrested the protestors, including Russo.
