National Guard Act of 1740
Section 1: Short Title
This Act may be cited as the National Guard Establishment Act of 1740
Section 2: Purpose
The purpose of this Act is to establish and organise the National Guard as a reserve military force under the authority of the federal government, to provide emergency response capabilities, ensure national security, and support state and local authorities in times of crisis, both domestic and abroad.
Section 3: Establishment of the National Guard
- The National Guard is hereby established as a permanent, multi-purpose reserve force consisting of both active and reserve components.
- The National Guard shall operate under the authority of the Secretary of Defence and will be part of the larger national defence structure, capable of mobilising and deploying personnel, equipment, and resources when needed.
- The National Guard will function as a vital backup force to the Confederate States Armed Forces in times of war or national emergency, with a primary role in domestic defence, emergency response, and supporting civil authorities.
Section 4: Structure of the National Guard
The National Guard will be composed of two components:
- Active National Guard – personnel who serve on a full-time basis, maintaining readiness for rapid deployment.
- Reserve National Guard – personnel who serve part-time and train periodically to ensure operational readiness when called upon.
The National Guard will be divided into State Guard Units based on geographical regions (e.g., states, territories, and the Federal District of Northcliff). Each unit will be responsible for the defence and emergency management of their respective areas while also participating in broader federal missions when needed.
Each State Guard Unit will be commanded by a State Guard Commander who will report to both the Governor of the state and the Secretary of Defense.
Section 5: Role and Responsibilities
The National Guard will perform the following duties:
- National Defence – Support national defence operations as directed by the President or the Department of Defence.
- Disaster Relief – Provide immediate response capabilities in the event of natural disasters (e.g., hurricanes, floods, earthquakes).
- Civil Support – Assist local law enforcement and other government entities in maintaining public safety during civil unrest or emergencies.
- Training and Readiness – Regular training for all National Guard personnel to maintain high operational standards and ensure readiness for deployment in all situations.
- Support for State and Local Authorities – Provide resources and personnel for law enforcement, emergency management, and civil functions when requested by state and local governments.
Section 6: Funding and Budgeting
The National Guard shall be allocated an annual budget by Congress, in accordance with the national defence budget and the needs of each state unit.
The National Guard shall receive funding for:
- Personnel salaries and benefits
- Equipment procurement and maintenance
- Training and readiness programs
- Operational costs during deployments
A portion of the National Guard budget will be allocated specifically for the procurement of critical technologies, infrastructure, and equipment necessary for the efficient operation of the force.
Section 7: Recruitment and Service Obligations
- Recruitment for the National Guard will be open to citizens of the United States, aged 18-35, who meet physical, mental, and educational standards set forth by the Department of Defence.
- Active-duty personnel shall commit to a minimum of 3 years of service, while reserve personnel will be required to train for a minimum of 1 weekend per month and participate in annual training.
- The National Guard shall offer educational benefits, healthcare, housing stipends, and retirement plans to ensure recruitment and retention of qualified personnel.
Section 8: Command Structure
- The National Guard will be commanded by a Chief of the National Guard Bureau, who will report to the President through the Secretary of Defence.
- Each State Guard Unit will be under the command of the State Governor in peacetime, but can be federalised for national service under the authority of the President in times of crisis or conflict.
- Commanders will be responsible for ensuring the effective deployment of forces and equipment, maintaining readiness, and providing reports on operational status.
Section 9: Coordination with Federal and State Agencies
- The National Guard shall maintain a cooperative relationship with federal, state, and local agencies, ensuring smooth coordination in times of disaster or emergency response.
- National Guard personnel may be called upon to support local law enforcement, or other agencies during state and national emergencies.
- Protocols for coordination between the National Guard and other agencies will be developed and maintained by the Department of Defence, local authorities, and the National Guard Bureau.
Section 10: Oversight and Accountability
- The National Guard shall be subject to regular audits and oversight by the Congressional Armed Services Committee and the Department of Defence.
- A National Guard Inspector General will be established to monitor compliance with policies, effectiveness, and the proper use of resources.
- Reports on the National Guard’s budget, readiness, and mission effectiveness will be submitted to Congress annually.
Section 11: Activation and Mobilization
- The President may activate the National Guard during national emergencies, armed conflict, or other situations requiring federal intervention.
- The National Guard may be mobilized for:
- Active duty military operations
- Domestic disaster relief and recovery operations
- Civil disturbance control
- National Guard personnel may be deployed within 24-72 hours of activation, depending on the nature of the emergency.
Section 12: Rights and Benefits
- National Guard members shall be entitled to the same benefits as active-duty military personnel when activated for federal service, including pay, housing allowances, healthcare, and retirement benefits.
- National Guard members who are injured in the line of duty shall be eligible for compensation and medical care under the same standards as regular military personnel.
- National Guard personnel shall also have access to higher education benefits, including tuition assistance and vocational training.
Section 13: Repeal of Conflicting Laws
Any law, regulation, or policy in conflict with the provisions of this Act shall be repealed or amended as necessary to ensure its consistency with the creation and operation of the National Guard.
Section 14: Effective Date
This Act shall take effect immediately upon enactment, and the process for organizing and staffing the National Guard shall begin no later than 1740.1, with full operational status to be achieved by 1740,1.
