The Free trade agreement between Kurum Ash-Sharqia and New Batavia is a treaty that was signed on 9 December 2021 at Patriottenbaai.

Background

After the peaceful secession of Kurum Ash-Sharqia from New Batavia, there were calls for an extensive free trade agreement between the two nations. Free trade of goods was negotiated, except for fossil fuel, weapons, medicines and others. A level playing field was also negotiated, with minimum standards for fiscal policy, social security and labor conditions, as well as ecological concerns. The parties also agreed to join the Micras Intellectual Property Protection Act.

At the signing ceremony, President Mehmet Arslan was presented the Grand Cordon in the Order of As-Saif.

DE SULTAN VAN HET SULTANAAT KURUM ASH-SHARQIA

DE PRESIDENT VAN DE ISLAMITISCHE REPUBLIEK NIEUW-BATAVIË

hebben elkaar ontmoet,

bevestigen hun toewijding aan internationale vrijhandel,

en zijn het eens geworden over de volgende principes die in dit vrijhandelsverdrag zijn vastgelegd:


Hoofdstuk 1: Algemene bepalingen, inwerkingtreding, opzegging

Artikel 1. Het Sultanaat Kurum Ash-Sharqia en de Islamitische Republiek Nieuw-Batavië sluiten een vrijhandelsverdrag ter bevordering van de handel in goederen tussen hen.

Artikel 2. Dit verdrag zal in werking treden na de ratificatie ervan door beide hoge verdragsluitende partijen in overeenstemming met hun nationale grondwettelijke procedures.

Artikel 3. Dit verdrag kan enkel worden geamendeerd, herzien, vergroot of uitgebreid na het akkoord van beide hoge verdragsluitende partijen. Elke tegengestelde actie is nietig.

Artikel 4. Dit verdrag kan door de hoge verdragsluitende partijen opgezegd worden mits een opzegperiode van 2 jaar in de Norton kalender.

Hoofdstuk 2: Vrijhandel van goederen

Artikel 5. Er bestaat tussen de hoge verdragsluitende partijen een vrije handel in goederen, onder deze voorwaarden:

a. De goederen werden volledig of voornamelijk geproduceerd op het grondgebied van een van de hoge verdragsluitende partijen.

b. De goederen werden geproduceerd door geregistreerde bedrijven met zetel in een van de hoge verdragsluitende partijen.

Artikel 6. De volgende goederen worden uitgesloten van dit akkoord:

a. Fossiele brandstoffen

b. Wapens en onderdelen van wapens

c. Medicijnen

d. Elektriciteitsproductie en -distributie

e. Drinkwatervoorziening

Artikel 7. De hoge verdragsluitende partijen zullen geen importtarieven heffen op de goederen die onder dit verdrag vallen, of de handel in deze goederen onredelijk belemmeren of bemoeilijken.

Artikel 8. De hoge verdragsluitende partijen kunnen regels opleggen waaraan de goederen moeten voldoen om verkocht te kunnen worden, zoals het vermelden van ingrediënten, kwaliteitseisen, enz.

Artikel 9. Zee- en luchthavens zullen open blijven voor leveringen vanwege de andere partij.

Hoofdstuk 3: Minimumnormen

Artikel 10. De hoge verdragsluitende partijen verbinden zich ertoe te voldoen aan fiscale minimumnormen, door de regeringen van de hoge verdragsluitende partijen verder te verfijnen:

a. Er is een vennootschapsbelasting van minstens 15 %.

b. Het subsidiebeleid van de overheden werkt niet marktverstorend voor de goederen die onder dit verdrag vallen.

Artikel 11. De hoge verdragsluitende partijen verbinden zich ertoe te voldoen aan sociale minimumnormen, door de regeringen van de hoge verdragsluitende partijen verder te verfijnen:

a. Er bestaat een achturendag en een veertigurenweek.

b. Er is een sociale zekerheid, met werkloosheidsvergoeding, pensioen en ziekteverzekering.

c. Vakbonden zijn toegelaten, er is een stakingsrecht en een vorm van sociaal overleg.

Artikel 12. De hoge verdragsluitende partijen streven ernaar te voldoen aan ecologische minimumnormen, door de regeringen van de hoge verdragsluitende partijen verder te verfijnen:

a. Er bestaan normen die schade aan het milieu en het klimaat beperken.

b. Er is aandacht voor circulaire economie.

Artikel 13. De hoge verdragsluitende partijen zullen intellectuele eigendom beschermen en binnen 3 jaren in de Norton kalender het verdrag “Micras Intellectual Property Protection Act (MIPPA)” onderschrijven.

Hoofdstuk 4: Arbitrage

Artikel 14. De hoge verdragsluitende partijen richten een arbitragetribunaal op, dat zal tussenkomen bij conflicten die rijzen uit de toepassing van dit verdrag.

Artikel 15. Conflicten over de toepassing van dit verdrag kunnen worden ingeleid door elke partij die beweerd schade te hebben geleden, of door de hoge verdragsluitende partijen zelf.

Artikel 16. Elke hoge verdragsluitende partij zal drie arbiters aanwijzen, zij duiden onder elkaar een voorzitter aan.

Artikel 17. De arbiters horen elke partij en kunnen bijkomende vragen stellen.

Artikel 18. Het arbitraal vonnis moet voldoen aan de volgende voorwaarden om rechtsgeldig te zijn:

a. Het moet de identiteit van de partijen bevatten en hun hoedanigheid als eisende of verwerende partij.

b. Het moet vermelden of de aanklacht aanvaard wordt of niet. Indien de aanklacht aanvaard wordt, moet de grond waarop de aanklacht gebaseerd is, vermeld worden.

c. Het moet vermelden of de rechter zich bevoegd acht voor het behandelen van de zaak.

d. Het moet beargumenteerd zijn.

e. Ten slotte volgt de uitspraak ten gronde.

Artikel 19. Het arbitraal vonnis wordt uitgesproken in het openbaar.

Artikel 20. Het arbitraal vonnis is bindend voor alle partijen.


TEN BLIJKE WAARVAN de voormelde hoge verdragsluitende partijen hebben genaamtekend en hun zegels aangehecht.

have met,

reaffirm their commitment to international free trade,

and agree on the following principles laid down in this FTA:


Chapter 1: General provisions, entry into force, repeal

Article 1. The Sultanate of Kurum Ash-Sharqia and the Islamic Republic of New Batavia have signed a free trade agreement to promote trade in goods between them.

Article 2. This Treaty will enter into force after its ratification by both high contracting parties in accordance with their national constitutional procedures.

Article 3. This Convention may be amended, revised, enlarged or extended only after the agreement of both high contracting parties. Any contrary action is null and void.

Article 4. This treaty can be repealed by the high contracting parties on the condition of a notice of 2 years in the Norton calendar.

Chapter 2: Free trade in goods

Article 5. There shall be free trade in goods between the high contracting parties under these conditions:

a. The goods were produced wholly or mainly in the territory of one of the high contracting parties.

b. The goods were produced by registered companies with their seat in one of the high contracting parties.

Article 6. The following goods are excluded from this agreement:

a. Fossil fuels

b. Weapons and parts of weapons

c. Medicines

d. Electricity production and distribution

e. Drinking water supply

Article 7. The high contracting parties shall not impose import tariffs on the goods covered by this treaty, or unreasonably impede or obstruct trade in such goods.

Article 8. The high contracting parties may impose rules that the goods must comply with in order to be sold, such as the indication of ingredients, quality requirements, etc.

Article 9. Sea and airports will remain open for deliveries from the other party.

Chapter 3: Minimum standards

Article 10. The high contracting parties undertake to comply with minimum fiscal standards, to be refined by the Governments of the high contracting parties:

a. There is a corporate income tax of at least 15%.

b. The subsidy policy of the governments does not distort the market for the goods covered by this treaty.

Article 11. The high contracting parties undertake to comply with minimum social standards, to be refined by the Governments of the high contracting parties:

a. There is an eight-hour working day and a forty-hour working week.

b. There is a social security, with unemployment benefits, pension and health insurance.

c. Trade unions are allowed, there is a right to strike and a form of social consultation between employers and employees.

Article 12. The high contracting parties shall endeavor to meet minimum ecological standards, to be refined by the Governments of the high contracting parties:

a. There are standards that limit damage to the environment and the climate.

b. Attention is paid to the circular economy.

Article 13. The high contracting parties will protect intellectual property and will sign the "Micras Intellectual Property Protection Act (MIPPA)" within 3 years in the Norton calendar.

Chapter 4: Arbitration

Article 14. The high contracting parties shall establish an arbitral tribunal which shall intervene in conflicts arising from the application of this treaty.

Article 15. Conflicts over the application of this treaty may be initiated by any party claiming to have suffered harm, or by the high contracting parties themselves.

Article 16. Each high contracting party shall appoint three arbitrators, who shall appoint a chairman among themselves.

Article 17. The arbitrators hear each party and may ask additional questions.

Article 18. The arbitral award must meet the following conditions to be legally valid:

a. It must include the identity of the parties and their capacity as plaintiff or defendant.

b. It must state whether the charge is accepted or not. If the charge is accepted, the ground on which the charge is based must be stated.

c. It must state whether the tribunal considers itself competent to hear the case.

d. It must be argued.

e. Finally, the actual award follows.

Article 19. The arbitral award shall be pronounced in public.

Article 20. The arbitral award shall be binding on all parties.


IN WITNESS WHEREOF, the aforementioned high contracting parties have signed and attached their seals.
