Background

Text of Legislation

Purpose

An Act respecting statistics of Caputia, and organize the Caputian Statistical System; among other purposes.

Enactment Clause

BE IT ENACTED, therefore, by the Queen's Most Excellent Majesty, by and with the advice and consent of the Lords and Burgesses in this present Parliament assembled, and by the authority of the same, as follows:

Article One: Citation

This Act shall be officially cited as the “Caputian Statistics Authority Act, 1661”, or the “CapuStat Act, 1661”.

Article Two: Definitions

1. In this Act,

a) “Chief Statistician” means the Chief Statistician of Caputia appointed under the provisions of this Act;

b) “department or departments of government” means any department, board, bureau, or other division of Her Majesty’s Government or of the government of a Caputian state or possession or any agency of either;

c) “identifying information” means any information that makes it possible to identify an individual person, business or organization;

d) “Minister” means such member of the Queen’s Privy Council as is designated by the Queen-in-Council as the Minister for the purposes of this Act;

e) “respondent” means a person in respect of whom or in respect of whose activities any report or information is sought or provided pursuant to this Act.

Article Three: Caputian Statistics Authority

1. The Caputian Statistics Authority is hereby created, to be known as CapuStat, as an independent body corporate and part of Her Majesty’s Government, known as the Caputian Statistics Authority, or CapuStat.

2. CapuStat shall serve as the premiere and central statistical authority of the Government. Information produced by CapuStat shall be authoritative and official.

3. The duties of CapuStat are:

a) to collect, compile, analyze, abstract and publish statistical information relating to the commercial, industrial, financial, social, economic and general activities and condition of the people;

b) to collaborate with departments of government in the collection, compilation and publication of statistical information, including statistics derived from the activities of those departments;

c) to take the census of population of Caputia and the census of agriculture of Caputia as provided in this Act;

d) to promote the avoidance of duplication in the information collected by departments of government; and

e) generally, to promote and develop integrated social and economic statistics pertaining to the whole of Caputia and to each of its states and possessions thereof and to coordinate plans for the integration of those statistics.

Article Four: Chief Statistician of Caputia

1. The Queen-in-Council shall appoint the Chief Statistician of Caputia to be the deputy head of CapuStat.

2. The Chief Statistician holds office for a term of not more than five years during good behavior but may be removed for cause by the Queen-in-Council.

3. The Chief Statistician is eligible to be reappointed for an additional term of not more than five (5) AN years.

4. In the event of the absence or incapacity of the Chief Statistician, or if that office is vacant, the Queen-in-Council may appoint any qualified person to hold that office in the interim for a term not exceeding six (6) AN months, and that person shall, while holding office, be paid the salary or other remuneration and expenses that may be fixed by the Queen-in-Council.

5. The Chief Statistician shall, in addition to any other duties imposed on him or her under any other provision of this Act:

a) decide, based strictly on professional statistical standards that he or she considers appropriate, the methods and procedures for carrying out statistical programs regarding:

i) the collection, compilation, analysis, abstraction and publication of statistical information that is produced or is to be produced by CapuStat,

ii) the content of statistical releases and publications issued by CapuStat, and

iii) the timing and methods of dissemination of statistics compiled by CapuStat;

b) advise on matters pertaining to statistical programs of the departments and agencies of Her Majesty’s Government, and confer with those departments and agencies to that end; and

c) control the operations and staff of CapuStat.

6. Each year, the Chief Statistician shall make a report to the Ministry of Home Affairs on the activities of CapuStat in the preceding year, and that report shall be included as a separate part of the Minister’s reports to Parliament.

7. Directives on any methods, procedures and operations may only be issued to the Chief Statistician by the Queen-in-Council.

8. On the day on which an order is made, the Minister of Home Affairs shall cause a copy of the order to be tabled in each House of Parliament.

9. If Parliament is not sitting, the order shall be sent to the Woolsack within 15 days after the day on which the order is made.

10. The Minister may issue directives to the Chief Statistician on the statistical programs that aim to collect, compile, analyze, abstract and publish statistics on all or any of the matters referred to in this Act.

11. The Chief Statistician may require that any directive issued to him or her under this Act be made in writing and made public before the Chief Statistician acts on it.

12. The Chief Statistician may employ, in the manner authorized by law, any commissioners, enumerators, agents or other persons that are necessary to collect for CapuStat the statistics and information that Her Majesty’s Government considers useful and in the public interest relating to the commercial, industrial, financial, social, economic and other activities that the Government may determine. The duties of the commissioners, enumerators, agents or other persons shall be those duties prescribed by the Chief Statistician.

13. The Minister may, for such periods as Her Majesty’s Government may determine, use the services of any employee of the national public administration in the exercise or performance of any duty, power or function of CapuStat or an officer of CapuStat under this Act or any other Act, and any person whose services are so used shall, for the purposes of this Act, be deemed to be a person employed under this Act.

14. The Chief Statistician shall determine whether a request for information is mandatory or voluntary, except for the census of population and census of agriculture, both of which are mandatory.

15. The Chief Statistician shall publish any mandatory request for information before the request is made.

16. The Chief Statistician shall notify the Minister of Home Affairs of any new mandatory request for information at least one (1) AN year before the day on which it is published.

Article Five: Caputian Statistics Advisory Council

1. An advisory council, to be known as the Caputian Statistics Advisory Council, is established:

a) to advise Her Majesty’s Government and the Chief Statistician in a transparent manner on any question that either of them has referred to the Council on the overall quality of the national statistical system, including the relevance, accuracy, accessibility and timeliness of its data; and

b) to make public an annual report on the state of the national statistical system.

2. The Council is composed of, in addition to the Chief Statistician, not more than forty (40) other members appointed by the Queen-in-Council to hold office during pleasure, including one (1) Chairperson and one (1) Secretary.

3. The Chief Statistician is an ex officio member of the Council.

4. The Chairperson is appointed to a term of not more than five (5) AN years and may be reappointed for an additional term of three (3) AN years.

5. The other members are appointed to a term of three (3) AN years and may be reappointed for an additional term of three (3) AN years.

6. The members of the Council shall be paid the remuneration that is fixed by the Queen-in-Council and are entitled to be paid any reasonable travel and living expenses that are incurred while absent from their ordinary place of residence in the course of performing their duties under this Act.

7. Despite any other provision of this Act, the Chief Statistician may authorize the use of sampling methods for the collection of statistics.

8. Members of the Council must be distinguished members of the academe and legal professions, and those learned in economics, statistics, accountancy, the sciences, and the social sciences, and the arts, and thereafter known as Academicians.

Article Six: Population Census and Agriculture Census

1. A census of population of Caputia shall be taken every three (3) AN years by CapuStat, in coordination with the Ministry of Home Affairs, at a time within that AN year of Her Majesty’s Government’s choosing.

2. The census of population shall be taken in such a manner as to ensure that counts of the population are provided for each state and possession of Caputia, as constituted at the time of each census of population.

3. A census of agriculture of Caputia shall be taken by CapuStat every (3) AN years, in coordination with the Ministry of Home Affairs, at a time within that AN year of Her Majesty’s Government’s choosing.

4. The Queen-in-Council shall, by order, prescribe the questions to be asked in any census taken by CapuStat under this Act.

Article Seven: General Statistics

1. Without limiting the duties of CapuStat under this Act, or affecting any of its powers or duties in respect of any specific statistics that may otherwise be authorized or required under this Act, the Chief Statistician shall collect, compile, analyze, abstract and publish statistics in relation to all or any of the following matters in Caputia: a) Population; b) Agriculture; c) Health and welfare; d) Law enforcement, the administration of justice and corrections; e) Government and business finance; f) Immigration and emigration; g) Education; h) Labor and employment; i) Commerce with other countries; j) Prices and the cost of living; k) Forestry, fishing and trapping; l) Mines, quarries and wells; m) Manufacturing; n) Construction; o) Transportation, storage and communication; p) Electric power, gas and water utilities; q) Wholesale and retail trade; r) Finance, insurance and real estate; s) Public administration; t) Community, business and personal services; and u) Any other matters prescribed by Parliament or an Order-in-Council.

Article Eight: Duty to provide information, cooperation with CapuStat

1. A person to whom a mandatory request for information is made shall provide the information to CapuStat, properly certified as accurate, not later than the time prescribed by the Chief Statistician and indicated to the person or not later than the extended time that may be allowed in the discretion of the Chief Statistician.

2. All instrumentalities of the Government are required to cooperate with CapuStat. Failure to do so without sufficient cause shall be liable to Obstruction of Her Majesty's Law as provided by the law.

Commencement Clause

This act shall not become law until it has received Royal Assent.
