WIPAnglien article
The Transitional Judiciary of the Free Duchy of Anglien (Crandan: Tüssentiitse Rechtspleging fonn Anglien) is the system of courts established by the Charter of Anglien to administer justice in the Free Duchy of Anglien during the transitional period between the promulgation of the Charter on 15.X.1754 and the ratification of a permanent constitution targeted for 1759. The system was created under conditions unusual in the Raspur Pact's post-conflict experience: the pre-collapse Lac Glaceian court infrastructure, which had served the territory as a cantonal judicial system before the NKR insurrection, had been comprehensively destroyed during the occupation, and the NKR's summary tribunals had no legitimate successors. The Transitional Judiciary is accordingly a court system reconstituted from the foundations, with heavy international participation during the transitional period and with a professional bench trained in substantial part through the Concord Alliance Military Assistance Mission to Anglien's (CAMA-A) rule-of-law advisory contingent.

The Charter establishes a three-tier general court system comprising the Supreme Transitional Court of Anglien at the highest tier, the Ducal Circuit Courts at the second tier, and the Bailiwick Courts at the third tier. The general courts are supplemented by the Special NKR Tribunals, a specialized criminal jurisdiction dedicated to the prosecution of war crimes and other serious offenses committed under NKR authority during the occupation of 1752–1754. Appeals from all lower courts and from the Special Tribunals lie to the Supreme Transitional Court, which also exercises original jurisdiction over constitutional questions and over disputes between the ducal administration and the Diet of Anglien.

Two features of the Transitional Judiciary are particular to its transitional character. The first is the requirement, imposed by the Charter at the insistence of the CATO Commissioner of Peace for Anglien during the Charter's drafting, that the Supreme Transitional Court and the Special NKR Tribunals include international jurists nominated by the Concord Alliance. The second is the Truth and Reconciliation Commission's position as the formal charging authority for offenses committed under NKR authority, whose referrals are the principal and in most cases the exclusive source of proceedings before the Special NKR Tribunals. Both features are products of the transitional settlement and both are expected to be reconsidered, in whole or in part, by the Constitutional Diet's Committee on Institutions in the course of its work on the permanent constitution.

The Transitional Judiciary is administered through the Ministry of Justice of Anglien in respect of its budget, premises, and administrative support, but the Charter designates the courts as independent of ministerial direction in their adjudicative work. Hendrik Braam, a former resistance judge-advocate during the occupation, serves as Minister of Justice and is responsible to the Diet of Anglien for the Ministry's administration of the courts. The Ducal Police Service, though institutionally part of the Ministry, is functionally separate from the courts in the manner of most civil-law jurisdictions.

Background
NKR insurrection
The territory of what became the Free Duchy had functioned, in the decades before the NKR insurrection, as a cantonal jurisdiction within the Grand Duchy of Lac Glacei. Cantonal courts in Johannsessbuurg, Bergbuurg, Shelsa, and other principal towns had administered civil and criminal matters under Lac Glaceian law, with appeals lying to Lac Glaceian appellate courts in Monte Glacei and to the Grand Duchy's highest court. The canton's legal profession, though small, had been broadly integrated with the wider Lac Glaceian bar, and judges had been appointed through cantonal procedures operating under Grand Duchy oversight.

The Nü Krantisk Repüblik dissolved this structure in the first months of the occupation. Cantonal courts were closed; sitting judges were dismissed, in several cases detained, and in at least four confirmed cases killed; and the summary tribunals established by the NKR administration operated without legal professionals, without procedural rules, and without appellate review. The tribunals' records, such as they were kept, were in many cases destroyed in the closing months of the occupation. Civil registration ceased across most of the territory. Land registries were destroyed, falsified, or removed in several bailiwicks. The documentary foundations on which any court system depends, judicial records, cadastral surveys, registers of births and marriages, registers of commercial activity, professional rolls, had been substantially degraded by the time the Natopian-led intervention expelled NKR forces in IX.1754.

The drafters of the Charter accordingly faced the problem of constituting a court system without the administrative and professional infrastructure on which reconstitution of the pre-occupation Lac Glaceian courts would have depended. They had no pool of qualified Anglian jurists sufficient to staff a full court system; the surviving Lac Glaceian legal profession had largely relocated to Monte Glacei or abroad, and the handful of qualified jurists who had remained in Anglien through the occupation had done so at considerable personal risk and could not realistically staff the new courts without assistance. The CATO Commissioner of Peace's legal advisors, drawn from legal professionals across the Concord Alliance's member states, proposed a three-tier system with international participation at the highest tier and in the specialized NKR jurisdiction, together with a training program administered through CAMA-A that would over time produce a qualified Anglian professional bench. This was the model adopted by the Charter and refined by the foundational statutes passed by the Diet of Anglien in XI.1754.

Legal framework
The Transitional Judiciary is established by Chapter IV of the Charter. Procedural detail is provided by the Transitional Judiciary Ordinance, among the twelve foundational statutes passed by the Diet of Anglien in its first session of XI.1754, and by subordinate rules of court issued by the Supreme Transitional Court of Anglien.

The Charter's judicial provisions establish:
* The three-tier structure of the general courts and the specialized jurisdiction of the Special NKR Tribunals;
* The appointment procedures for each tier, including the requirement of Diet confirmation for Supreme Court justices and the joint role of the Ministry of Justice and CAMA-A in the vetting of Bailiwick Court judges;
* The requirement that the Supreme Transitional Court include a minimum of two CATO-nominated international jurists during the transitional period, and that the Special NKR Tribunals include one international jurist on each three-judge panel;
* The principle of judicial independence, including a prohibition on ministerial direction of adjudicative work and provisions for removal from office only by joint action of the Sovereign Duke and the Diet on grounds of incapacity or professional misconduct;
* The principle of public proceedings, subject to the courts' authority to conduct sensitive hearings in closed session;
* The rights of the accused and of civil litigants, including the right to counsel, the right to present evidence, the right to appeal, and the right to interpretation into Crandish, Anglo-Saksen, or Alexandrian where the party does not speak the language of proceedings;
* The status of Crandish as the language of record of the courts, with provision for evidence and proceedings in other languages subject to translation for the record.

The Charter also authorizes the courts to give direct effect to Micras Treaty Organization instruments to which the Free Duchy is party, to the extent that their terms are clear and their application does not require domestic implementing legislation. This provision has principally concerned the duchy's obligations under the Convention on the Establishment of a Common Court and the Micras Intellectual Property Protection Act.

The Transitional Judiciary Ordinance provides detailed procedural rules, including the civil and criminal procedure codes, evidentiary rules, rules governing the conduct of appeals, and rules governing the relationship between the general courts and the Special NKR Tribunals and between both and the Truth and Reconciliation Commission of Anglien. The Ordinance is explicitly provisional; the Charter contemplates its replacement by permanent codes once the constitutional process is complete.

Structure
The Transitional Judiciary comprises four courts and court systems, organized into a three-tier general jurisdiction and a specialized NKR criminal jurisdiction.

Supreme Transitional Court of Anglien
Supreme Transitional Court of Anglien
The Supreme Transitional Court of Anglien is the highest court of the Free Duchy during the transitional period. It sits in Johannsessbuurg in a former appellate courthouse restored for the purpose, and is composed of five justices appointed by the Sovereign Duke subject to confirmation by an absolute majority of the Diet of Anglien. The Charter requires that at least two of the five justices be international jurists nominated by the Concord Alliance; by convention, three Anglian justices sit with two international justices, a division that has been maintained through the Court's first full term.

The Court exercises original jurisdiction over constitutional questions and over disputes between the ducal administration and the Diet of Anglien, and appellate jurisdiction over all lower courts of the Free Duchy and over the Special NKR Tribunals. Its decisions are binding on the lower courts and bind subsequent panels of the Court itself under a doctrine of precedent adapted from both the Lac Glaceian civil-law tradition and the practice of the Concord Alliance's international jurists.

The Court sits en banc on matters of constitutional significance and on appeals from the Special NKR Tribunals. Other matters are heard by a quorum of three. Decisions are issued in Crandish with translations into Istvanistani provided for the major judgments; translations into Anglo-Saksen, Alexandrian, and Mala'anje are prepared for judgments of particular significance to the affected communities.

Ducal Circuit Courts
Ducal Circuit Courts of Anglien
The Ducal Circuit Courts are the second-tier general courts of the Free Duchy. They exercise original jurisdiction over civil disputes above a statutory monetary threshold, over serious criminal matters, and over appeals from the Bailiwick Courts. Cases are heard by three-judge panels; judges are appointed by the Sovereign Duke on recommendation of the Ministry of Justice and serve on circuits that rotate among the bailiwicks, sitting for extended periods in Johannsessbuurg, Bergbuurg, and Shelsa and on shorter circuits in the smaller bailiwicks.

The rotating character of the circuit bench reflects both the small size of the Anglian professional bench and the practical need to bring judicial services to districts that lost their cantonal courts during the occupation. The CAMA-A rule-of-law advisory contingent provides ongoing training and procedural support to circuit judges, and the Supreme Transitional Court has been active in the issuance of procedural rules that circuit judges apply uniformly across the duchy.

Bailiwick Courts
Bailiwick Courts of Anglien
The Bailiwick Courts are the third-tier general courts and the principal point of judicial contact with the population. Each of the duchy's bailiwicks, eleven at the system's establishment and twelve since the territorial incorporation of 1756, is served by at least one Bailiwick Court, sitting as a single-judge court of first instance with jurisdiction over minor civil and criminal matters, land and property disputes, small-claims litigation, and appeals from local administrative authorities. The courts' caseload is dominated by the property and registration work arising from the occupation: disputes over the reconstruction of land records, claims arising under the TRCA's property restitution orders, and the administrative appeals that have followed the reconstitution of the bailiwick councils.

Most Bailiwick Court judges had no formal legal training prior to their appointment. The pool of qualified Anglian lawyers was small before the occupation and was reduced further by displacement and casualties during the insurrection; recruitment has accordingly drawn on former cantonal administrators, notaries, and in a substantial minority of cases former resistance figures whose practical authority in their communities qualified them for the role in the absence of formal legal credentials. Judges are vetted by the Ministry of Justice and by CAMA-A rule-of-law advisors before appointment by the Sovereign Duke. CAMA-A's ongoing training and institutional support to the Bailiwick bench, including procedural training, continuing legal education, and court administration support, is the most substantial of the mission's civilian advisory programs.

Special NKR Tribunals of Anglien
Special NKR Tribunals of Anglien
The Special NKR Tribunals of Anglien are a specialized criminal jurisdiction established by the Charter to try offenses committed under NKR authority during the occupation. The Tribunals have jurisdiction over war crimes, crimes against humanity, unlawful execution, enforced disappearance, and destruction of religious property. Each case is heard by a three-judge panel comprising two Anglian judges and one CATO-nominated international jurist.

Proceedings before the Tribunals are instituted by referral from the Truth and Reconciliation Commission, which under the Charter is the formal charging authority for offenses within the Tribunals' jurisdiction. Direct indictment is available only where authorized by the Supreme Transitional Court, on application by the Ministry of Justice and on a showing of good cause for bypassing the TRCA's referral process. This mechanism has been invoked rarely in practice; the TRCA's referrals have been the source of all but a small number of prosecutions to date.

Defendants for crimes against the laws of war and humanity originally arrested by the armed services of the United Kingdom of Meckelnburgh during the kingdom's occupation of northern Anglien in the Meckelno–Nü Krantisk War were transferred from the Military Criminal Tribunal for the former Lac Glacei to the Special NKR Tribunals.

Tribunal proceedings are conducted in Crandish; proceedings may also be conducted wholly or in part in Istvanistani or Anglo-Saksen where the accused, a witness, or the international jurist on the panel requires it, subject to contemporaneous translation into the language of record. Sentencing is governed by the Charter's criminal provisions and by the Transitional Judiciary Ordinance; the maximum penalty available is life imprisonment, the Charter having abolished capital punishment as part of its foundational rights provisions.

Appeals from the Special NKR Tribunals lie to the Supreme Transitional Court. The Supreme Court sits en banc on all such appeals, with its international justices participating alongside its Anglian justices.

Appointments
Judicial appointments in the Transitional Judiciary follow procedures that differ among the tiers, reflecting the different institutional functions of each court.

Supreme Transitional Court justices are appointed by the Sovereign Duke subject to confirmation by an absolute majority of the Diet of Anglien. The Duke consults the Council of Ministers on Anglian appointments and consults the CATO Commissioner of Peace on international appointments, but retains the formal nomination authority. In practice, the international justices have been selected from jurists nominated by the Concord Council after consultation with the Sovereign Duke, who has retained a veto over the nominations. The procedure reflects Edgard III's characterization of judicial appointments as one of the three areas of direct ducal control he has retained from the powers formally vested in the office, alongside foreign affairs and TRCA composition.

Ducal Circuit Court judges are appointed by the Sovereign Duke on the recommendation of the Ministry of Justice. The Charter does not require Diet confirmation for Circuit appointments. The Minister of Justice's recommendations are informed by the advice of a Judicial Appointments Advisory Committee established under the Transitional Judiciary Ordinance, composed of two sitting Supreme Court justices, one sitting Circuit judge, and two senior CAMA-A legal advisors.

Bailiwick Court judges are vetted by the Ministry of Justice and by CAMA-A rule-of-law advisors and appointed by the Sovereign Duke on recommendation of the Ministry. The Ordinance prescribes minimum criteria, including integrity, community standing, and aptitude for adjudicative work, but does not require formal legal qualifications; most Bailiwick judges complete a structured CAMA-A training program in the first year of their service.

Removal from judicial office is effected only by joint action of the Sovereign Duke and the Diet, on grounds of incapacity or professional misconduct, following investigation by a committee of the Supreme Court. No judicial removals have occurred since the establishment of the Transitional Judiciary.

International participation
The requirement of international jurists in the Supreme Transitional Court and in the Special NKR Tribunals was insisted upon by the CATO Commissioner of Peace during the Charter's drafting and was accepted by Edgard III on the grounds that no qualified pool of Anglian jurists existed capable of staffing the courts independently, and that international participation would serve as a check against both bias toward collaborators and politically motivated prosecutions. The requirement is explicitly provisional and is one of the principal items before the Constitutional Diet's Committee on Institutions.

International justices on the Supreme Transitional Court have been drawn from jurists with prior service on courts of the Concord Alliance's member states. Early appointments included jurists with prior service in Aerla and Natopia; the Concord Council has indicated that nominations may be drawn from a wider pool as the transitional period continues. International jurists on the Special NKR Tribunals have been nominated through the same process, with particular weight given to candidates with prior experience in post-conflict criminal jurisdictions.

The international jurists sit alongside their Anglian colleagues on equal terms; they do not operate as a separate chamber or as a reviewing body, but as full members of the panels on which they serve. Their presence has been cited by the CATO Commissioner of Peace as a principal feature of the Charter's Chapter IX benchmarks on rule of law and as a factor in the continued conditionality of CATO grant disbursements.

CAMA-A rule-of-law support
Concord Alliance Military Assistance Mission to Anglien
The civilian advisory component of CAMA-A, distinct from its military training mission, provides continuous institutional support to the Transitional Judiciary. CAMA-A legal advisors are drawn from legal professionals across the Concord Alliance's member states, with New Alexandrian, Aerlan, and Natopian advisors forming the largest national cohorts. The advisors serve on renewable two-year secondments, allowing for the rotation of personnel and the incorporation of evolving professional practice into the Anglian bench.

CAMA-A's principal areas of activity include the training of Bailiwick Court judges, the development of procedural rules for use across the court system, continuing legal education for serving judges and for the small Anglian private bar, the vetting of candidates for Bailiwick and Circuit appointments, and institutional support to the Ministry of Justice and the Supreme Transitional Court. The civilian advisory contingent also supports the TRCA and the Special NKR Tribunals in areas including investigative technique, evidentiary handling, and the preparation of cases for referral and trial.

The civilian advisory contingent is expected to continue under a successor arrangement after the formal conclusion of CAMA-A's military mandate in 1759. The terms of any successor arrangement have not been formalized; an informal understanding reached between the Ministry of External Affairs and the Concord Alliance contemplates a reduced advisory presence in the Ministry of Justice and the Supreme Court for a defined period after the transition.

Relationship with the Truth and Reconciliation Commission
Truth and Reconciliation Commission of Anglien
The Transitional Judiciary's relationship with the Truth and Reconciliation Commission of Anglien is governed by the Charter and elaborated in the Transitional Judiciary Ordinance. The relationship operates through three principal channels.

First, the TRCA's property restitution orders are directly enforceable in the Ducal Circuit Courts and Bailiwick Courts without further judicial review on the merits. The courts retain authority over the execution of the orders, including the resolution of disputes arising out of implementation, but they may not reopen the Commission's findings as to unlawful seizure or as to the identity of the rightful owner.

Second, the TRCA is the formal charging authority for offenses within the Special NKR Tribunals' jurisdiction. Tribunal proceedings are instituted by TRCA referral, and direct indictment is available only on order of the Supreme Transitional Court. Tribunal decisions are reviewable on appeal to the Supreme Transitional Court, which may affirm, reverse, or modify the Tribunal's judgment and may order retrial before a differently constituted panel.

Third, appeals from the TRCA's administrative determinations, particularly its bars from public office and licensed professions imposed by the Chamber of Collaboration and Public Life, lie to the Supreme Transitional Court. The Court has established a procedural track for such appeals that permits expedited hearing where the applicant's livelihood is materially affected.

Reform and the permanent constitution
The Transitional Judiciary was designed to be temporary. The Charter contemplates its replacement, or substantial reorganization, as part of the permanent constitutional framework ratified by the 1759 national referendum. The Constitutional Diet's Committee on Institutions, chaired by the Speaker John Gautier, is the principal body considering the permanent judiciary's design.

Several questions are understood to be before the Committee. The most significant concerns the continued participation of international jurists. The CAMA-A civilian advisory contingent has published research suggesting that a transition from mandatory international participation to optional international secondments, with qualified Anglian jurists taking the lead as their numbers permit, would be achievable within three to five years of the permanent constitution's ratification. The Committee's early deliberations suggest broad support for this direction, though the precise terms of the transition have not been settled.

A second question concerns the relationship between the ducal administration and the judiciary. The Charter's present arrangements, under which the Sovereign Duke appoints justices and judges and may remove them only jointly with the Diet, have been characterized by several Committee members as inappropriate to a permanent constitutional settlement. Proposals under consideration include an independent Judicial Council with exclusive appointment authority, a simplified removal procedure managed through the Council, and constraints on the Sovereign Duke's role that would render the appointment power largely formal.

A third question concerns the future of the Special NKR Tribunals and the TRCA. Early deliberations within the Committee suggest consensus that the investigative and restitution work of the TRCA will need to continue beyond the formal end of the transitional period. Whether its work continues as a reconstituted permanent commission, as a specialized division of the permanent judiciary, or through reallocation among the general courts and the Ministry of Justice, is an open question that the Committee has not yet resolved.

Finally, the Committee is considering whether Bailiwick Courts should remain single-judge courts and whether Ducal Circuit Courts should retain their rotating character, or whether a more conventional sedentary bench should be established as professional capacity develops. Associated with this question is the future of the CAMA-A civilian advisory contingent's extensive role in the training and support of the bench.

Languages of proceedings
Crandish is the language of record of all courts in the Free Duchy. Proceedings may be conducted in Anglo-Saksen, Alexandrian, or Mala'anje where the parties and the court concur, subject to contemporaneous translation into Crandish for the record. Parties have the right to interpretation into a language they understand, at the expense of the court, in any proceeding in which they are not fluent in the language of proceedings.

International jurists on the Supreme Transitional Court and on the Special NKR Tribunals typically conduct their portions of the work in Istvanistani; judgments and decisions in which international jurists participate are prepared in Crandish and in Istvanistani in parallel, with the Crandish version controlling in cases of divergence. Translations into the minority languages are prepared where the decision is of particular significance to the minority community concerned.
