[MCS] Ownership of Intellectual Property

We have a situation. It concerns the continent which is occupied by Gotzborg, Anthelia, Natopia, Rio Grande, and a colony of Alexandria.<br>
<br>
Each of the abovenamed micronations dealt with the MCS in good faith, assuming the following -<br>
<br>
1. The MCS owns the map of Micras and the right to assign territory according to its own rules.<br>
<br>
2. A micronation which uses the approved process to obtain a territorial allocation from MCS <!--EZCODE ITALIC START--><em>ipso facto</em><!--EZCODE ITALIC END--> enters into an agreement not only with MCS but with all the other micronations which have done likewise.<br>
<br>
3. The geographical feature names on unallocated territory (and seas) belong to the MCS.<br>
<br>
4. The allocation of territory to a micronation by MCS implicitly includes the right to use the geographical feature names associated with that territory.<br>
<br>
Anthelia has been leading a joint symposium, with the abovementioned micronations, to develop the details of our continent's geography and climate, using the pre-existing MCS data as a baseline. Now, the problem is this: Bill Dusch is asserting the supremacy of his prior work in designing that particular continent. He is insisting that the legacy of his prior work should take precedence over our new work. He does this in spite of our contention that none of his legacy was evident in the map data available from MCS when we (the micronations holding a stake in the matter) dealt with MCS to gain the rights to our land. Before we can proceed, we need a ruling from the MCS, which we acknowledge as the only competent authority concerning the Micras map.<br>
<br>
1. Do our micronations have the rights to the mountain, river and marine features appearing on the physical map before our arrival? Or does intellectual property ownership extend beyond the names of nations and cities formerly appearing?<br>
<br>
2. Do our micronations have the right to fill-in the physical details of our territories which are not evident on the world-scale map? Or does our right of use extend only to placing provincial borders and cities?<br>
<br>
3. Will the MCS instruct Bill to file his ancient history of the continent in the Apollo Foundation archives where it belongs? Or does the MCS prefer to allow Bill to interfere, for solely personal reasons, in the business of micronations who have a stake in the land which he abandoned some time ago.<br>

Bill has no intellectual property rights over the MCS map. While he may have created the continent in question, he did not copyright it in his own name, instead it fell under the copyright of the MCS (in its form on the map - not Bill's civilization rendered maps). <br>
<br>
The continent present on the MCS world map is not the intellectual property of one Bill Dusch. It is legally the intellectural property of the Micronational Cartography Society, which has copyrighted the map on which the continent lies for the past five years.<br>
<br>
Bill gave up any claim he had on the MCS continent. His only claim legally relates to his personal maps that lie off of the MCS world map. Anthelia et al. are operating legally in determining the characterisitics of that continent so long as the MCS permits them to do so. Bill has no say or control over that continent, so you can ignore him.

It strikes me that Bill is simply hurting his reputation on this one. He could have <!--EZCODE ITALIC START--><em>offered</em><!--EZCODE ITALIC END--> hs services instead of demanding entry, and could have been more pliable on the issue of his precious already made history. But now he's screwed himself over.

He did sorta offer, however his original posting was a little aggressive, which he recognized at the time and apologized for. Unfortunately though, his desire to see 'preservation' of micronational culture conflicting with the way things are really happening. Bill has commented that he feels that his desire to see the history maintained is strong and can sometimes cause him to react more emotionally. <br>
<br>
This is understandable but unfortunately one cannot argue/debate or discuss effectively until emotion is removed from the discussion otherwise there continues to be an escalation of both threats and emotion until reason is absent completely.<br>
<br>
I am done on this topic and would recommend we get back to doing the fun stuff instead of getting caught up in the crap.<br>
