...not to mention that copyrighting it won't stop people from copying it.

not wanting to pour oil on the copyright issue, but master davis has overlooked a crucial section, when he gave an overview of the exclusive rights of a copyright owner:

Quote:

Section 106A. ...independent of the exclusive rights provided in section 106,
the author of a work -
(1) shall have the right -
(A) to claim authorship of that work, and
...
(3) shall have the right -
(A) to prevent any intentional distortion, mutilation, or other modification of that work which would be prejudicial to his or her honor or reputation, and any intentional distortion, mutilation, or modification of that work is a violation of that right, and
(B) to prevent any destruction of a work of recognized stature, and any intentional or grossly negligent destruction of that work is a violation of that right.

(b) Only the author of a work ...whether or not the author is the copyright owner have the rights conferred by this section. The authors of a joint work are coowners of the rights conferred by this section.

Copyright registration is thus a requirement to exercise the exclusive rights as explained by mr. davis, but such registration is not a condition for copyright protection, in particular for the moral rights which each author, as initial owner, retains.

Section 411:

Quote:
Except for an action brought for a violation of the rights of
the author under section 106A(a), ..., no action for infringement of the copyright in any United States work shall be instituted until registration of the copyright claim has been made in accordance with this title.

In any case, only the original copyright owner or the person to which copyright has been transferred (and then he should proove how and when) may register a copyright. The Copyright Office should, if they know so, refuse registration of a copyright by someone who does not own the copyright.

section 410:

Quote:
In any case in which the Register of Copyrights determines that, in accordance with the provisions of this title, the material deposited does not constitute copyrightable subject matter or that the claim is invalid for any other reason, the Register shall refuse registration and shall notify the applicant in writing of the reasons for such refusal.

If the registration has already been processed, though luck for anyone who believes to be the copyright owner, but he can still invoke the moral rights of authorship, if original authorship can be proven. The registration form won't help here as a defense.

If the registration has not yet been processed, the alleged copyright owner should definitly think of contacting the Register of Copyrights in order to avoid (alleged) illegal registration.

anyway, just my two *annoying* cents
The fact that people refuse to actually READ prior posts, but aren't shy about just hopping on the bandwagon of arguing something they dont understand is like a pet peeve of mine. Anyway - at NO time was I attempting to argue the point of Ownership. And I never stated that Copyright Registration = Ownership. I was merely stating what Ryan's rights as Copyright holder are.

I'm not going to sit here and argue over the points of ownership and authorship. YES the Authors have rights as well - but I was not intending to discuss those points, only what Ryan can do as Copyright holder.

If you want to jump into a conversation and be the big man, etc - that's totally cool. But next time, at least try to understand what the others are saying first; that way you can save us all the trouble of thinking you actually had something to contribute.

The status of the copyright is not something I want being thrown about as casual discussion. If someone has an issue, they can contact me in private.

Any other concerns about the TOS can be discussed in a new thread, since I'm closing this one.
